These terms govern your use of the DegenBrawlers interface at degenbrawlers.com.

DRAFT — PENDING LEGAL REVIEW. These terms have not yet been reviewed by licensed legal counsel. They are provided in draft form and will be updated prior to mainnet launch. Do not rely on these terms as final legal guidance.

UNAUDITED SMART CONTRACT. The Protocol smart contract has not undergone a formal third-party security audit. This deployment is on Solana devnet only. Do not commit real funds until an audit has been completed and published.

1Nature of This Interface

DegenBrawlers (this "Interface") is a web-based front-end application that provides a graphical user interface for interacting with an autonomous smart contract deployed on the Solana blockchain (the "Protocol"). The Interface does not custody, transmit, or control any digital assets. All transactions are executed directly on the Solana blockchain by you using your own wallet software.

The Protocol operates autonomously according to its published open-source code. No party — including the developers of this Interface — controls the execution of the Protocol. Once a transaction is submitted to the Solana network, it cannot be reversed, cancelled, or modified by any person.

You may interact with the Protocol directly without using this Interface. The availability or unavailability of this Interface does not affect the Protocol itself.

2Acceptance of Terms

By accessing or using this Interface, you represent that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy and Risk Disclosure. If you do not agree, do not use this Interface.

These terms constitute a legally binding agreement between you and the Interface operators. Your continued use of the Interface following any updates to these terms constitutes acceptance of the revised terms.

4Restricted Jurisdictions

Access to this Interface is restricted in the following jurisdictions. If you are located in or are a resident of any of these regions, you must not use this Interface:

This list may be updated at any time to reflect applicable law and sanctions requirements. Automated geo-restriction is applied as a technical measure but is not guaranteed to be complete. You are responsible for ensuring your use complies with local laws regardless of whether geo-restriction is applied.

5Description of the Protocol

The Protocol enables participants to allocate SOL tokens in support of one of ten (10) "fighters" in a community voting game. Each voting round, participants cast votes to eliminate one fighter. Participants who backed the surviving fighter at the end of the final round receive a proportional share of the total pool, minus a 2% protocol fee that is automatically transferred to the protocol fee address at the time of contract execution.

Allocation of SOL tokens to the Protocol constitutes a transfer of those tokens to an autonomous smart contract vault. These tokens are not recoverable except through Protocol-defined claim mechanisms. There is no guarantee of any return. You may lose all tokens you allocate.

6Financial Risk Acknowledgment

Interacting with the Protocol involves substantial financial risk. You should only allocate tokens that you can afford to lose entirely. By using this Interface, you acknowledge and accept that:

7Protocol Fee

The Protocol automatically deducts a 2% fee from the total pool at the time winnings are distributed. This fee is hardcoded in the smart contract and cannot be altered by this Interface or its operators. The fee is transferred to the protocol fee address at the smart contract level. By interacting with the Protocol, you acknowledge and accept this fee.

8No Warranties

THIS INTERFACE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE INTERFACE OPERATORS DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

The Interface operators do not warrant that the Interface will be error-free, uninterrupted, secure, or that defects will be corrected. The Interface operators do not warrant that the Protocol will function as intended or that funds will not be lost.

9Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE INTERFACE OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DIGITAL ASSETS, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE INTERFACE OR PROTOCOL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE AGGREGATE LIABILITY OF THE INTERFACE OPERATORS TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE INTERFACE SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNTS YOU PAID TO USE THE INTERFACE IN THE TWELVE MONTHS PRECEDING THE CLAIM (EXCLUDING PROTOCOL FEES).

Some jurisdictions do not allow limitation of liability for consequential damages. In such jurisdictions, the above limitation applies to the maximum extent permitted by law.

11Intellectual Property

The Interface, including its design, graphics, and text content, is the property of the Interface operators or their licensors. The underlying Protocol smart contract code is open-source under the MIT License. Nothing in these Terms grants you any right to use any trademarks, service marks, logos, or trade names.

12Privacy

Our collection and use of information is described in our Privacy Policy. By using the Interface, you consent to the practices described therein. This Interface is designed to collect minimal data. Your wallet address and on-chain transactions are public information on the Solana blockchain and are not subject to deletion requests.

13Dispute Resolution — Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Interface shall be finally resolved by binding arbitration under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.

The arbitration shall be conducted in the English language. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LITIGATION.

Note: Arbitration clause may be updated following legal review to reflect entity jurisdiction.

14Governing Law

The Interface operators reserve the right to modify these Terms at any time. Updated Terms will be posted at this URL with a revised "Last updated" date. Your continued use of the Interface after any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

17Severability and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force. These Terms, together with the Privacy Policy and Risk Disclosure, constitute the entire agreement between you and the Interface operators regarding your use of the Interface and supersede all prior agreements.
